WearetheFore Ltd (“The Fore”). TERMS AND CONDITIONS.
All the Fore Clients as defined by this Agreement below (“Clients”), and those periodically visiting the Fore studio (“the Studio”) as Guests of Clients or of The Fore (together “You”) must comply with the following Terms and Conditions.
These Terms and Conditions are incorporated into every agreement for the provision of fitness or wellbeing services entered into between You and The Fore, its Partners, Agents and Independent Contractors.
Any person who does not comply with these Terms and Conditions may be ejected from or denied access to The Fore (“the Studio”) and/or any of the services provided therein or may have their contractual or other financial agreement terminated at the sole discretion of the Directors of The Fore, in the event that the non-compliance is serious or repeated. We reserve the right to make reasonable amendments to these Terms and Conditions, at any time. If we do this, we will give Clients reasonable advance notice.
DEFINITION OF TERMS
Agents: All persons expressly authorised by the Directors of The Fore, to act on their behalf.
Clients: Those individuals and groups participating in personal training sessions (individual or joint), TRX classes (including all classes booked through external organisations or intermediaries such as ClassPass), yoga classes and physiotherapy sessions. For the avoidance of doubt, any individual participating in a single session as defined under Fitness Services will be deemed to be a Client.
Directors of The Fore: Hannah Lanel: WearetheFore Ltd.
Fitness Services: Including but not limited to, the provision of personal training services (individual and joint sessions), TRX classes, yoga classes and physiotherapy sessions and Alternative Medicine.
Guests: Including but not limited to any person or persons accompanying a Client, all persons attending for the purposes of observation or media, whether at the invitation of The Fore or its Clients.
Independent Contractors: All personal trainers engaged by the Director of The Fore, providers of physiotherapy services and external class providers including but not limited to yoga classes.
Studio: The Fore’s premises R7 14-18 Handyside Street, London, N!C 4DN
1. CLIENTS’ RESPONSIBILITIES

1.1 Any items or personal belongings brought by Clients and retained in the Studio for any duration is entirely at the Client’s own risk. We do not accept any liability for personal belongings
1.2 Clients must not take any pictures, or movie shots (whether by use of a camera, mobile phone or other device), or post the same on any social media or public outlet, of any other Client or Guest of The Fore without the Client or Guest’s express knowledge and consent. We reserve the right to remove any persons acting on violation of this term and terminate the provision of all fitness or treatment services to that person immediately
1.3 At all times, each Client should conduct themselves in a manner that will not disturb or impair the use and enjoyment of the Studio by any other person. In particular, Clients may not use foul, loud, or abusive language, nor will they behave in a threatening manner; molest, or harass, other Clients, Guests, Visitors, or The Fore Director, their Agents or Independent Contractors.
1.4 Clients may not bring, use, or be under the influence of illegal drugs in the Studio and may not bring any intoxicating liquor into the Studio
1.5 Clients must ensure they wear clean exercise clothing and shoes must be worn whilst exercising. In particular, footwear must be suitable.

2. HEALTH AND FITNESS

2.1 Acceptance and provision of all fitness and wellbeing services is at our absolute discretion (although we will exercise our discretion reasonably, and in compliance with applicable laws).
2.2 Provision of all fitness and treatment services is upon the condition that the Client has confirmed that they have read, understood and accepted these Terms and Conditions. We reserve the right to refuse or withdraw provision of fitness and treatment services to any Client who has failed to agree to these Terms and Conditions
2.3 It is the sole responsibility of each Client to draw to our specific attention and keep us fully informed in advance of and during each fitness or treatment session, the following:
2.3.1 Any serious or other health conditions which may impact or are at risk of impacting their physical fitness, well-being and ability to participate in fitness and/or treatment sessions
2.3.2 Any change, deterioration or progression of any health condition that may impact or is at risk of impacting their physical fitness, well-being and ability to participate in fitness and/or treatment sessions
2.3.3 Any medication which they are currently taking and the side effects thereof
2.3.4 Any medical or other professional advice they have received in respect of their participation in fitness or treatment activities
2.3.5 During the course of any fitness or treatment session, any pain or other physical effects that place their physical well-being at risk
2.4 No Client will participate in any fitness or treatment activity unless they are fit and able to do so without risk of injury and without endangering their health and safety
2.5 Every Client undertakes to fully comply with any medical or professional advice or recommendations in respect of the performance of fitness or treatment sessions, irrespective of whether they have drawn the same to our attention
2.6 Every Client must, at the time of registering and whenever using our facilities and Services, be in good health and have no disability, impairment, injury, disease or ailment preventing them from engaging in active exercise or which would cause increased risk of injury or adverse health consequences as a result of use of our facilities or Services.
2.7 If a Client has any injury that may prevent full participation they should discuss this with the instructor before the Session begins and any advice given by our instructors does not constitute medical advice.
2.8 Clients are required to follow the instructions of instructors at all times during a Session.

3. GUESTS AND VISITORS

3.1 Clients (over the age of 18) may bring Guests to Studio at our sole discretion
3.2. Clients must accompany their Guest at all times, and the Client who brings the guest remains responsible for their Guest’s conduct, health, safety and well-being whilst they are in the Studio. The Client may not leave the Studio prior to their guest’s departure
3.3 It is the responsibility of each Client to ensure that at all times
3.3.1 The Guest complies with the Terms and Conditions of the Studio
3.3.2 The Guest does not act in any manner that causes or is at risk of causing, harm to themselves or to others visitors and users of the Studio
3.3.3 The Guest does not use any of the fitness equipment in the Studio without the express authorization of the Director of The Fore and only in the express manner prescribed or instructed by the Director of The Fore and only for the purposes for which such use is authorized
3.3.4 The Guest does not interfere with or obstruct the provision of services or the enjoyment or such services by Clients
3.3.5 The Guest does not interfere with, damage or otherwise handle, any personal belongings of the Director of The Fore, their Independent Contractors or Agents, Clients or their Guests
3.3.6 The Guest must not take any pictures, or movie shots (whether by use of a camera, mobile phone or other device), or post the same on any social media or public outlet, of any Client or Guest of The Fore without the Client or Guest’s express knowledge and consent
3.3.7 The Guest does not use foul, loud, or abusive language, nor will they behave in a threatening manner; molest, or harass, other Clients, Guests, Visitors, or The Fore Director, their Agents or Independent Contractors
3.3.8 The Guest does not bring, use, nor will be under the influence of illegal drugs in the Studio and may not bring any intoxicating liquor into the Studio
3.4 We reserve the right to eject any Guest from the Studio who does not comply with these Terms and Conditions or who otherwise compromises, through their verbal or physical conduct, the health, safety, welfare, service provision or enjoyment of services, of our Trainers, Service Providers, Clients and Guests
3.5 Clients may not bring pets (excluding Guide Dogs) to the Studio

4. SOCIAL AND OTHER MEDIA

4.1 We reserve the right to use any individual or group photographs or movie shots of you for press or promotional purposes, and by allowing yourself to be filmed, you consent to such usage.

5. STUDIO USE

5.1 You should seek instruction before using unfamiliar equipment.
5.2 Each Client undertakes that they will not use any of the fitness equipment in the Studio without the express authorization of the Director of The Fore, their Agents or Independent Contractors, and only in the express manner prescribed or instructed by the and only for the purposes for which such use is authorized
5.3 Clients must  arrive at the Studio ten (10) minutes prior to any fitness, treatment or induction appointments. We reserve the right to refuse to re-book an appointment for Clients if they repeatedly cancel (with less than 24 hours-notice) or fail to keep an appointment for services or treatments
5.4 Clients may not use the Studio or its facilities while under the influence of alcohol, anticoagulants, antihistamines, beta-blockers, narcotics, tranquilizers or any medication or other substance which may affect ability to exercise safely.

6. PERSONAL BELONGINGS

6.1 Clients are respectfully requested to store coats, bags, clothing, umbrellas and rucksacks in the lockers provided.
6.2. Lockers are made available subject to availability. We do not undertake that use of a locker will guarantee that no theft of or damage to your property will occur. We will not accept any liability in relation to locker thefts unless they result from our negligence. Clients should check that household contents or other insurance policy protects against any risk of theft.
6.3. With the exception of any designated private lockers, lockers are available for use only while Clients are on the Studio premises. Use of a locker while not on Studio premises is prohibited. If Clients leave belongings overnight in a locker we reserve the right to remove belongings.

7. HEALTH & SAFETY

7.1 Clients and Guests must use the main entrance to the Studio when entering or leaving
7.2. Fire exits, which are clearly marked, are there in the interests of safety and Clients and Guests must not interfere with fire doors for any reason.
7.3 Clients and Guests must read any health and safety notices posted outside, on or near any equipment or facility rooms the Studio and comply with their recommendations.
7.4.Clients and Guests must comply with any reasonable requests made by The Fore, its Agents or Independent Contractors in relation to matters of health and safety.

8. CHILDREN

8.1 Child Clients, under the age of 16, must be under direct adult supervision at all times.
8.2 Child Clients or Child Guests may only be brought into the Studio if accompanied by their Parent, legal guardian, or any other person who is authorized to and does take responsibility for them.
8.3 For the avoidance of doubt, The Fore does not act in loco parentis in respect of any Child Client or Child Guest at any time.

9. LIMITATION OF LIABILITY

9.1 The Fore shall not be liable for any personal injury, loss or damage suffered by any Client or Guest unless and to the extent that the same is caused or materially contributed to by the negligence, breach of statutory duty, unlawful omission or unlawful default of The Fore or its expressly authorized Agents
9.2 For the avoidance of doubt, The Fore is not liable for any personal injury, loss or damage suffered by any Client or Guest to the extent that the same is caused or materially contributed to by the negligence, breach of statutory duty, omission or default of its Independent Contractors, their employees or agents
9.3 The Fore is not liable for any personal injury, loss or damage suffered by any Client or Guest caused or materially contributed to by the negligence, breach of statutory duty, omission or default, of these Terms and Conditions or otherwise, of its Clients and their Guests

10. JURISDICTION

10.1 The terms of this agreement and enforcement thereof shall be governed by the law of England and Wales.
 
TERMS & CONDITIONS
Please read carefully the following Terms of Use, which may be updated from time to time by WEARETHEFORE Ltd (these “Terms”). These Terms define yours and WEARETHEFORE Ltd.’s rights and obligations. The most current version of these Terms can be accessed at any time at www.The-Fore.com (the “Site”). Changes to these Terms will be notified via posting on the Site (or other written notice to you).

ACCEPTANCE OF TERMS OF USE
By accessing, browsing, and/or using the Site and/or any facility operated by WEARETHEFORE Ltd (a “Studio”), you accept and agree to be bound to these Terms. In addition, when using particular WEARETHEFORE Ltd services, you also shall be subject to any posted guidelines, FAQs, or rules applicable to such services, which may be posted and modified from time to time.

MEMBERSHIP GENERAL TERMS

Membership Passes are a non-contract re-occurring payment that allows the user to access associated services. Passes are to be used by the holder only and cannot be shared.

A £12 “late cancel” fee is in place for Unlimited Pass holders for spots booked and cancelled less than 12 hours before the session. For all other Passes, there is no fee, but 1 credit will be lost for each session.

A £15 "no show" fee is in place for spots booked and not attended.

You are eligible to freeze your membership pass for a maximum of two times per calendar year, for a period of up to two weeks. The two-week period cannot be spilt over multiple freezes in one year and the two separate freezes are not allowed to be consecutive periods.
 
MEMBERSHIP CYCLE

Your Pass starts on the date that you sign up and submit payment via a valid Payment Method (as defined below).

A Pass cycle is 1 month in length, and will, subject to your Pass being cancelled (by you), or terminated (by us), in accordance with these Terms, automatically renew at the end of each cycle. For example, if you purchase your Pass on 5th April, it will automatically renew on 5th May (see “Billing Cycles” below). Once your new Pass cycle starts, you will have access to your Eligible Classes for the new Pass cycle. Unless specified, all memberships have a two month minimum term, so can't be cancelled until after your first two payments.

You must provide us with a current, valid, accepted method of payment (as such may be updated from time to time, “Payment Method”) to use the Studio. We will automatically bill the monthly Pass fee to your Payment Method each Pass cycle until your Pass is cancelled or terminated.

PACKS
Pack holders receive the number of classes commensurate with the pack purchased. Such classes may be redeemed at the studio until such time that the Pack is exhausted whether through consumption or expiry.

Pack holders may transfer or gift classes to third parties, including to other Pass holders or Pack holders. WEARETHEFORE Ltd makes no guarantee on the availability of classes as access to classes is on a space-available basis.

PACK EXPIRY
Your Pack starts on the date that you attend the first class. Packs contain between one and twenty classes. If unused they will expiry as follows:
Single – One-month expiry.
Five Classes – Three months expiry.
10 and 20 Classes - Six months expiry.
The expiry date on all packs can be extended by one month for £15.

BILLING
Recurring Billing.
By starting your Pass, you authorise us to charge you a monthly fee at the then current rate. Increases in the current rate will be notified with 1 months’ notice, after your monthly billing cycle.

Membership Billing Cycle.
When you sign up and purchase your Pass, your first pass cycle will be billed immediately. Your Pass will auto-renew on the same date each month (being the date on which the pass was activated), provided that, where such date does not exist in particular renewal month, your Pass will be deemed to auto-renew on the day immediately following the date of expiry of your current Pass cycle.

For example, if you signed up on January 31st, your next auto-renew date will be March 1st, and payment will be taken using your payment method on, or after that date. All Pass auto-renews will continue to take place on the new auto-renew date (i.e., in this example, the 1st of each month). Payment will be taken on the effective date of your auto-renew (a “Renewal Date”), provided that, if we are unable for any reason to take payment on a Renewal Date, we will take payment as soon as practically possible thereafter.

No Refunds.
Unless expressly stated to the contrary herein, or as provided by applicable law, payments are non-refundable and there are no refunds or credits for partially used periods.

This policy applies to all products sold on WEARETHEFORE Ltd.’s website i.e. packages of sessions as well as Passes. However, following your cancellation of your  Pass you will continue to have access to the studio through to the end of your paid Pass cycle.

Payment Methods.
You may edit your Payment Method information by logging into your WEARETHEFORE Ltd account and updating accordingly. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information, provided that you have not cancelled your account in accordance with these Terms (see, “Cancellation” below), you remain responsible for any uncollected amounts.

All memberships have a two month minimum term, so can't be cancelled until after your first two payments. You may terminate your Pass at any time from this point with at least 30 days prior notice ahead of a renewal date. For example, if your next renewal date is 30th September, you need to cancel by 1st September in order to avoid being charged for the next Pass cycle. Note that if you do terminate your 1R Pass, you will be subject to current membership rates upon your return.

It's the pass holder's responsibility to terminate their own billing cycle by logging into their online or contacting the studio via email. Please see "no refunds" policy.

OTHER FEES
Passes and/or Packs only give access to the class for which you signed up (at the specified time and location). You are responsible for paying no show fees of £15 / late cancel fees of £12, where applicable.
Cancellations within 12 hours of your booking will not be charged.

TERMINATION BY WEARETHEFORE LTD
You agree that WEARETHEFORE Ltd, in its sole discretion and for any or no reason, may terminate any account (or any part thereof) you may have with WEARETHEFORE Ltd or use of the Site and/or Studio and remove and discard all or any part of your account or any content uploaded by you, at any time.

WEARETHEFORE Ltd may also in its sole discretion and at any time discontinue providing access to the Site and/or Studio, or any part thereof, with or without notice. You agree that any termination of your access to the Site or any account you may have or portion thereof and/or Studio may be effected without prior notice, and you agree that WEARETHEFORE Ltd will not be liable to you or any third party for any such termination, provided that, if WEARETHEFORE Ltd terminates your account other than due to breach by you of these Terms, WEARETHEFORE Ltd shall refund a pro-rata proportion of the fee paid for the Pass /  Pack in which such termination takes effect.

WEARETHEFORE Ltd does not permit copyright infringing activities on the Site and reserves the right to terminate access to the Site and remove all content submitted by any persons who are found to be repeat infringers. Any suspected fraudulent, abusive, or illegal activity that may be grounds for termination of your use of the Site and/or Studio may be referred to appropriate law enforcement bodies. These remedies are in addition to any other remedies that WEARETHEFORE Ltd may have at law.

ELIGIBILITY;

REGISTRATION INFORMATION AND PASSWORD; SITE ACCESS

The site is not intended for use by persons outside the United Kingdom or to any users suspended or removed from the site by WEARETHEFORE Ltd. By using the site, you represent that you are a United Kingdom Resident who has not been previously suspended or removed from the site.

Applicable only to corporate accounts authorised by us:
If you are using or opening an account on the Site on behalf of a company, entity, or organization (a “Subscribing Organization”), then you represent and warrant that you are an authorised representative of that Subscribing Organization with the authority to bind such organisation to these Terms.

You agree that the information you provide to WEARETHEFORE Ltd on registration and at all other times will be true, accurate, current, and complete. You also agree that you will ensure that this information is kept accurate and up-to-date at all times. When you register, you will be asked to create a password. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account.

PRIVACY
Your privacy is important to WEARETHEFORE Ltd. The WEARETHEFORE Ltd Privacy Policy is hereby incorporated into these Terms by reference. Please read the privacy policy carefully for information relating to WEARETHEFORE Ltd.’s collection, use, and disclosure of your personal information.

PROHIBITED STUDIO CONDUCT
By using the Site, you promise to:

Respect our procedures
Respect our teams
Respect our customers
Respect our product

PROHIBITED SITE CONDUCT
By using the Site, you promise not to:
 
• Harass, threaten, or defraud Site users;
• Make unsolicited offers, advertisements, proposals, or send junk mail to users;
• Impersonate another person or access another user’s account without that person’s permission;
• Share WEARETHEFORE Ltd-issued passwords with any third party or encourage any other user to do so;
• Permit third parties to use any classes booked under your Pass, including other  Pass holders;
• Misrepresent the source, identity, or content of information transmitted via the Site, including deleting the copyright or other proprietary rights;
• Upload material (e.g., virus) that is damaging to computer systems or data of WEARETHEFORE Ltd or users of the Site;
• Upload copyrighted material that is not your own or that you do not have the legal right to distribute, display, and otherwise make available to others; or
• Upload or send to Site users pornographic, threatening, embarrassing, hateful, racially or ethnically insulting, libellous, or otherwise inappropriate content.
PROHIBITED SITE USES
Those who choose to access the Site do so at their own initiative and are responsible for compliance with all applicable laws.

As a condition of your use of the Site, you will not use the Site for any purpose that is unlawful or prohibited by these Terms.

You may not use the Site in any manner that, in our sole discretion, could damage, disable, overburden, or impair it or interfere with any other party’s use and enjoyment of the Site.

You may not attempt to gain unauthorised access to the Site, or any part of the Site, other accounts, computer systems or networks connected to the Site, or any part of them, through hacking, password mining, or any other means or interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site.

You may not remove, circumvent, disable, damage or otherwise interfere with security-related features of the Site, any features that prevent or restrict use or copying of any content accessible through the Site, or any features that enforce limitations on the use of the Site or the content therein.

You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Site.

You agree neither to modify the Site in any manner or form, nor to use modified versions of the Site, including (without limitation) for the purpose of obtaining unauthorized access to the Site.

The Site may contain robot exclusion headers. You agree that you will not use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission or bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Site.

You must be 18 years of age or older to use this Site and/or to purchase a Pass and/or Pack.
 
LIMITATION OF LIABILITY AND DAMAGES
Nothing in these terms (including but not limited to any “disclaimers” above and limitations of liability below) is intended to exclude or limit any liability that we may have to you by operation of applicable law. This includes liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation. It is acknowledged however, that we accept no liability for the negligence of third parties.

Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.

Under no circumstances, including, but not limited to, negligence, will WEARETHEFORE Ltd or its affiliates, contractors, employees, agents, or third party partners, or suppliers be liable for any special, indirect, incidental, consequential, punitive, or exemplary damages arise from or related to the use of the Studio and/or the site, including those that result from the use or the inability to use the facilities in the Studio or the materials on the site, or any other interactions with WEARETHEFORE Ltd, even if WEARETHEFORE Ltd or a WEARETHEFORE Ltd authorized representative has been advised of the possibility of such damages.

Applicable law may not allow limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In such cases, WEARETHEFORE Ltd.’s liability will be limited to the fullest extent permitted by applicable law.



DISPUTE RESOLUTION
General.
Generally, if a dispute arises between WEARETHEFORE Ltd and you, our goal is to provide you with a neutral and cost-effective means of resolving the dispute quickly. Accordingly, you and WEARETHEFORE Ltd agree that the parties will resolve any claim or controversy at law or equity that arises out of this Agreement or the Site (a “Claim”) in accordance with one of the subsections below or as you and we otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

Choice of Law; Forum.
These Terms shall be governed in all respects by the laws of England and Wales, without regard to conflict of law provisions. You agree that any claim or dispute you may have against WEARETHEFORE Ltd must be resolved by a court located in the United Kingdom, except as otherwise agreed by the parties. You agree to submit to the personal jurisdiction of the courts located within the UK for the purpose of litigating all such claims or disputes.


MISCELLANEOUS
Severability.
If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions.

Headings.
The heading references herein are for convenience purposes only, do not constitute a part of these Terms, and will not be deemed to limit or affect any of the provisions hereof.

Entire Agreement.
This (including the documents referred to herein), is the entire agreement between you and WEARETHEFORE Ltd relating to the subject matter herein and will not be modified except in writing, signed by both parties, or by a change to these Terms or Guidelines made by WEARETHEFORE Ltd as set forth in the Preamble to these Terms.

Disclosures.
The services hereunder are offered by WEARETHEFORE Ltd Limited, a limited liability company incorporated and registered in England and Wales with company number 12049528, whose registered office is located at: R7 14 HANDYSIDE ST, LONDON, N1C 4DN.
